Terms and Conditions

1. Cancellation and Rescheduling

Cancellations or rescheduling may be made at no charge up to 2 hours before the scheduled appointment time. Changes made within 2 hours of the appointment are subject to a $100 late cancellation or rescheduling fee for standard MLS and short-term rental packages.

For services with a scheduled duration of 3 hours or longer, late cancellation or rescheduling may be billed at the full cost of the services reserved.

In the event of weather concerns, rescheduling may be requested at no charge up to 1 hour before the appointment time. Standard cancellation policy applies otherwise.

If the photographer is unable to access the property at the scheduled time, if required access instructions are not provided, or if the property is not ready to be photographed upon arrival, the appointment may be considered completed and a trip fee or full service fee may apply.

All late cancellations or rescheduling requests must be communicated by phone.

2. Usage & Licensing

Upon full payment of the applicable invoice, Client is granted a non-exclusive, perpetual commercial license to use the media solely to market the specific property for which the services were performed. Permitted use includes MLS, listing websites, brokerage marketing, social media, and print materials directly related to promoting that property.

The Client may use the media in the future for professional self-promotion, including the display of past listings.

The Client may share or gift the media to the property owner in connection with the listing. The license is personal to the Client and is non-transferable. The media may not be assigned, sublicensed, or transferred to any other agent, brokerage, developer, builder, stager, designer, or other third party without prior written authorization from Photostetic LLC.

The media may not be resold, reassigned, or reused by another party for re-listing, resale marketing, development marketing, or other commercial purposes without authorization. Requests for extended or alternative usage may be submitted to Photostetic LLC, and additional licensing fees may apply.

These licensing terms apply to all standard MLS photography packages (residential and commercial) and short-term rental photography packages. For custom productions, branding projects, developments, commercial advertising, or other non-listing services, licensing terms may be defined separately in writing based on the client's requirements. Unless otherwise agreed in writing, the standard MLS licensing terms apply.

Photostetic LLC may display the media in its portfolio, website, social media, and marketing materials. Clients requiring confidentiality for privacy or security reasons may request exclusion in writing, and such requests will be honored.

Photo credit to Photostetic LLC shall be provided where reasonably practicable when the media is published in editorial, advertising, press, or promotional contexts where credits are customarily included. Credit is not required for MLS systems or listing platforms where attribution fields are not available.

3. Additional Fees

Any additional costs required to complete the shoot, including parking, valet, tolls, permits, or access fees, are the responsibility of the Client.

4. Payment Terms and Late Fees

Invoices are due by the stated due date. A late fee of 1.5% per month may be added to overdue balances. Unpaid accounts may be referred to collections, and Client agrees to be responsible for associated recovery costs.

Licensing rights are granted only after full payment is received.

5. Refund Policy

Services are custom and non-refundable once delivered. Reasonable re-editing will be provided in the event of technical errors.

6. Use of Subcontractors

Photostetic LLC may use independent contractors to perform services. Photostetic LLC is not liable for independent contractor actions beyond its reasonable control.

7. Delivery of Content

Delivery timelines are estimates and not guaranteed. Photostetic LLC is not liable for delays caused by editing requirements, weather, property conditions, technical issues, or circumstances beyond its control.

8. Accuracy

Images, video, virtual tours, and floor plans are for marketing purposes only. Measurements, dimensions, and representations are approximate and not intended for architectural, legal, engineering, or inspection use.

9. Property Preparation and Safety

The Client is responsible for ensuring the property is prepared and safe to photograph. Photostetic LLC reserves the right to decline or stop services if conditions are unsafe, hazardous, illegal, or inappropriate.

10. Drone Operations

Aerial photography is subject to FAA regulations, airspace restrictions, weather conditions, and safety considerations. Aerial capture is not guaranteed if flight is deemed unsafe, restricted, or prohibited.

11. Limitation of Liability

Photostetic LLC's liability for any claim arising from services shall not exceed the amount paid for those services. Photostetic LLC shall not be liable for indirect, incidental, or consequential damages.

12. Image Alteration

Photostetic LLC is not responsible for any modifications made to the media by third parties after delivery.

13. Force Majeure

Photostetic LLC is not liable for failure to perform due to events beyond reasonable control, including weather, illness, equipment failure, airspace restrictions, or government regulations.

14. Modifications to Terms

Photostetic LLC reserves the right to update these terms at any time.

15. Agreement to Terms

By booking services, placing an order, or using the services of Photostetic LLC, Client acknowledges that they have had the opportunity to review these Terms and Conditions and agree to be bound by them.
